These Terms of Service (“Terms”) govern your access to and use of the Happier Choices website at happierchoices.us, related webpages, email communications, content, tools, and services (collectively, the “Service”).
“Happier Choices,” “Happier Choices,” “we,” “us,” and “our” refer to the company operating the Service. “You” and “your” refer to any person who accesses or uses the Service.
Please read these Terms carefully. By accessing, using, or subscribing to any part of the Service, you agree to be bound by these Terms, our Privacy Policy, and any additional terms presented to you for specific features or offerings. If you do not agree, do not access or use the Service.
1. Agreement to These Terms
Your use of the Service constitutes your acceptance of these Terms as of the date you first access or use the Service.
If you subscribe to an email list, download a resource, submit content, or otherwise interact with a feature that requires acceptance, you also agree to any terms specifically presented during that interaction.
These Terms are effective as of October 1, 2026. We may update them from time to time as described in Section 15.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is older, to use the Service.
By using the Service, you represent that you meet this eligibility requirement and have the legal capacity to enter into these Terms. The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13.
If you use the Service on behalf of an organization or another person, you represent that you have authority to bind that organization or person to these Terms.
3. Description of the Service
Happier Choices is a wellbeing companion and educational platform designed to support small, practical steps relating to mental wellbeing, relationships, and personal financial stability.
The Service may include:
- Daily inspiration, reflection questions, gratitude prompts, and community gratitude-sharing tools;
- Educational resources concerning stress, anxiety, self-compassion, communication, mindfulness, grounding, and related topics;
- Curated recommendations for workbooks, books, meditation applications, sleep applications, and other wellbeing tools;
- Educational content concerning financial habits, personal stability, online income, and related topics;
- Email newsletters, free guides, checklists, reports, and other resources;
- Links to third-party products, services, websites, and affiliate offers; and
- Other features, content, and resources that we may introduce from time to time.
The Service is free to start, and we do not require a credit card to access free features. Certain third-party products, paid offerings, or future features may involve separate charges and separate terms, which will be disclosed before purchase where applicable.
We may add, modify, suspend, or discontinue any feature, content, resource, or part of the Service at any time. In-development products, including the Guided Journaling Kit, Anxiety Relief Mini-Course, and Couples Connection Guide, may be delayed, changed, added, or cancelled without notice or liability.
4. No Professional Advice
The Service is provided for general educational and informational purposes only. It is not a substitute for professional advice, diagnosis, treatment, or care.
Happier Choices does not provide:
- Medical, healthcare, or clinical advice;
- Psychological or psychiatric advice, counseling, diagnosis, or treatment;
- Therapy or a professional therapeutic relationship;
- Financial, investment, accounting, tax, or credit advice;
- Legal advice or legal services; or
- Any other professional advice or fiduciary service.
Your use of the Service does not create a doctor-patient, therapist-client, financial adviser-client, attorney-client, or other professional relationship between you and Happier Choices.
You should consult an appropriately qualified professional before making decisions involving your health, mental wellbeing, relationships, finances, taxes, legal rights, or other important personal matters.

If you are experiencing a mental-health crisis, believe you may harm yourself or another person, or require immediate assistance, contact emergency services or an appropriate crisis service in your location. Do not rely on the Service for emergency assistance.
5. Acceptable Use
You agree to use the Service lawfully, respectfully, and only for its intended purposes. You must not:
- Use the Service for any unlawful, fraudulent, harmful, abusive, or deceptive purpose;
- Violate any applicable law, regulation, court order, or third-party right;
- Scrape, crawl, copy, harvest, index, download, or collect content or user information through automated means, except as permitted by our written authorization or applicable law;
- Use bots, spiders, scripts, automated tools, or similar methods to access, monitor, or interact with the Service without our written permission;
- Reverse engineer, decompile, disassemble, modify, or attempt to discover the source code or underlying structure of any part of the Service;
- Attempt to gain unauthorized access to the Service, our systems, accounts, or another user’s information;
- Interfere with or disrupt the Service, servers, networks, or security features;
- Upload or transmit malware, viruses, malicious code, corrupted files, or other harmful material;
- Harass, threaten, intimidate, defame, impersonate, or abuse another person;
- Submit content that is unlawful, fraudulent, threatening, defamatory, obscene, invasive of privacy, discriminatory, hateful, or otherwise harmful;
- Resell, sublicense, commercially exploit, republish, distribute, or provide access to the Service or its content without our written permission;
- Copy or republish substantial portions of the Service or its content without permission;
- Remove, alter, or obscure copyright, trademark, attribution, or other proprietary notices;
- Misrepresent your identity, affiliation, authority, or relationship with Happier Choices;
- Use another person’s account, email address, or credentials without authorization;
- Use the Service to provide professional advice or services to others in a manner that suggests Happier Choices endorses or supervises that advice; or
- Encourage, assist, or enable another person to violate these Terms.
We may investigate suspected violations and may take appropriate action, including removing content, limiting access, suspending accounts, terminating access, or referring matters to law enforcement.
6. User Submissions and Community Content
The Service may allow you to submit, post, upload, share, or otherwise provide content, including gratitude notes, comments, responses, reviews, suggestions, feedback, text, images, or other materials (“User Content”).
You retain ownership of your User Content. However, by submitting User Content through the Service, you grant Happier Choices a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, perform, format, adapt, modify, distribute, and use your User Content in connection with operating, improving, promoting, and providing the Service.
This license continues for as long as necessary to provide the Service and to maintain ordinary backups, records, or materials created through your use of the Service. We may remove or discontinue use of User Content at any time.
You represent and warrant that:
- You own your User Content or have all rights and permissions necessary to submit it and grant the license above;
- Your User Content does not violate these Terms or any applicable law;
- Your User Content does not infringe, misappropriate, or violate another person’s intellectual-property, privacy, publicity, contractual, or other rights; and
- Your User Content does not contain malware or other harmful code.
You are responsible for your User Content. We do not endorse User Content and are not responsible for its accuracy, reliability, legality, or suitability.
We may, but are not required to, monitor, review, moderate, edit, restrict, or remove User Content. We may remove content that we believe violates these Terms, creates risk, is inappropriate for the Service, or may expose users or Happier Choices to harm or liability.
Do not submit confidential, highly sensitive, or personally identifying information that you do not want shared or used in connection with the Service.
7. Intellectual Property
The Service and its content, including text, articles, guides, graphics, designs, photographs, videos, audio, software, compilations, organization, logos, trademarks, service marks, names, and branding, are owned by or licensed to Happier Choices and are protected by copyright, trademark, and other applicable laws.
Except for your User Content, Happier Choices retains all rights, title, and interest in and to the Service and its content.
Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial, informational purposes.
You may download or print reasonable portions of the Service for your personal use, provided that you do not remove proprietary notices, modify the materials, distribute them commercially, or represent them as your own.
No rights are granted by implication or otherwise except as expressly stated in these Terms. Any use outside the scope of this license requires our prior written permission.
“Happier Choices” and related names, logos, and marks are trademarks or trade names of Happier Choices or their respective owners. You may not use them without prior written permission.
8. Third-Party Products, Links, and Affiliates
The Service may contain links, advertisements, recommendations, reviews, tracking links, or other references to third-party products, services, applications, websites, programs, or providers.
Happier Choices may receive compensation if you click a link, sign up for, or purchase a product or service through an affiliate link. Affiliate relationships generally do not change the price you pay, but the third party may pay Happier Choices a commission or other compensation.
Affiliate recommendations are optional and are not endorsements, guarantees, or requirements. We aim to present recommendations honestly, but we do not guarantee that a third-party product or service will meet your needs or produce a particular result.
Happier Choices does not control and is not responsible for third-party products, services, content, policies, security, availability, pricing, performance, representations, or practices. Your dealings with third parties are solely between you and the applicable third party.
Any purchase, subscription, enrollment, or other transaction with a third party is governed by that third party’s terms, privacy policy, refund policy, and other applicable rules. You should review those terms before proceeding.
Happier Choices is not responsible for refunds, cancellations, disputes, customer service, delivery, product quality, or results relating to a third-party offering.
9. Emails and Other Communications
By subscribing to our email list, requesting a free resource, submitting your email address, or otherwise opting in, you agree to receive communications from Happier Choices, including newsletters, educational materials, updates, announcements, and promotional or affiliate-related content, subject to applicable law.
You may unsubscribe from marketing emails at any time by:
- Clicking the “unsubscribe” link in the applicable email;
- Using the preference-management link provided in the email; or
We will process unsubscribe requests in accordance with applicable law. Unsubscribing from marketing communications may not prevent us from sending necessary transactional, administrative, security, or service-related communications.
You are responsible for providing an accurate and current email address and for maintaining access to the email account you provide. We are not responsible for communications that cannot be delivered because your email address is inaccurate, inactive, blocked, full, or otherwise unavailable.
You must not use the Service to subscribe another person to communications without that person’s authorization.
10. Disclaimers of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT, MATERIALS, FEATURES, AND INFORMATION PROVIDED THROUGH THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE FULLEST EXTENT PERMITTED BY LAW, HAPPIER CHOICES DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND SECURITY.
WE DO NOT WARRANT THAT:
- The Service will meet your needs or expectations;
- The Service will be uninterrupted, timely, secure, or error-free;
- Any errors or defects will be corrected;
- The Service or its content will be accurate, complete, current, or reliable;
- The Service will be free from viruses, malicious code, or other harmful components;
- Any recommendation, resource, exercise, practice, product, or service will produce a particular result; or
- Your mental wellbeing, relationships, finances, income, business performance, or other circumstances will improve as a result of using the Service.
Any reliance you place on the Service is at your own risk. Some jurisdictions do not allow certain warranty exclusions, so some of the exclusions above may not apply to you.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HAPPIER CHOICES AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND BUSINESS PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO:
- Your access to or use of, or inability to access or use, the Service;
- Any content, recommendation, communication, product, or service made available through the Service;
- Your interaction or transaction with a third party;
- Any unauthorized access to or alteration of your content or information;
- Any interruption, delay, error, defect, security incident, virus, or other harmful component; or
- These Terms or the relationship between you and Happier Choices.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF HAPPIER CHOICES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO HAPPIER CHOICES FOR THE SERVICE DURING THE 12-month PERIOD BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Because some jurisdictions do not allow the exclusion or limitation of certain damages, these limitations may not apply to you. Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Happier Choices and its owners, officers, directors, employees, contractors, agents, affiliates, licensors, service providers, and business partners from and against any claims, demands, actions, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- Your access to or use of the Service;
- Your User Content;
- Your violation of these Terms;
- Your violation of any applicable law or third-party right;
- Your misuse of the Service; or
- Your dealings with or purchases from a third party.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification. You agree to cooperate with our defense of such claims. You may not settle any claim without our prior written consent if the settlement imposes an obligation, admission, or liability on Happier Choices.
13. Suspension and Termination
We may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe that:
- You violated these Terms;
- Your use creates a security, legal, operational, or reputational risk;
- Your conduct harms or threatens another person, the Service, or Happier Choices;
- We are required to do so by law or legal process; or
- We discontinue or materially change the Service.
You may stop using the Service at any time. You may also unsubscribe from marketing emails as described in Section 9.
Upon termination or suspension, your right to access and use the affected portion of the Service ends immediately. Sections that by their nature should survive termination will survive, including provisions concerning intellectual property, User Content licenses, disclaimers, limitations of liability, indemnification, dispute resolution, and general terms.
Termination does not affect rights or obligations that accrued before termination.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms and any dispute arising out of or relating to the Service or these Terms will be governed by the laws of the State of Arizona, without regard to its conflict-of-law rules.
Subject to the dispute-resolution provisions below, the state and federal courts located in Arizona will have exclusive jurisdiction, and you consent to personal jurisdiction and venue in those courts.
14.2 Informal Resolution
Before filing a lawsuit, you and Happier Choices agree to try in good faith to resolve the dispute informally.
The parties will have 30 days after receipt of written notice describing the dispute, the relevant facts, and the requested resolution to attempt an informal resolution, unless they agree otherwise.
This informal-resolution requirement does not prevent either party from seeking emergency injunctive or equitable relief when necessary to prevent immediate harm.
15. Changes to These Terms
We may update or revise these Terms from time to time. When we make changes, we will post the revised Terms on the Service and update the “Last Updated” date above.
If a change is material, we may provide additional notice where required by law, such as by email or a notice on the Service.
Your continued use of the Service after revised Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
16. General Terms
16.1 Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
16.2 Entire Agreement
These Terms, together with the Privacy Policy, applicable disclaimers, and any additional terms expressly incorporated by reference, constitute the entire agreement between you and Happier Choices concerning the Service and supersede all prior or contemporaneous understandings concerning the same subject.
16.3 Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, sale of assets, or operation of law.
16.4 No Waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later. A waiver must be in writing and signed by an authorized representative of Happier Choices.
16.5 No Agency
These Terms do not create a partnership, joint venture, employment, agency, franchise, fiduciary, or professional relationship between you and Happier Choices.
16.6 Force Majeure
Happier Choices will not be liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, power or internet outages, governmental actions, public-health emergencies, cyberattacks, or failures of third-party providers.
16.7 Notices
We may provide notices through the Service, by email, or by other reasonable means. Notices to Happier Choices must be sent to the contact information below or any updated contact information published on the Service.
